Two Court of Appeals Judges to Retire in 2021

Judge Leslie Stein and Judge Eugene Fahey were confirmed together and will retire together.  The two judges have been part of a group of judges who have cast the deciding votes in many of the Court’s cases.

Judge Stein plans to retire from the Court of Appeals in June 2021.  This week she sent Chief Judge DiFiore a letter informing the Chief Judge of her retirement plans.  Gov. Cuomo nominated Judge Stein to the Court, and the New York State Senate confirmed her appointment in February 2015.

Judge Stein’s retirement follows over 20 years of service in the New York State judiciary.  Prior to her appointment to the Court of Appeals, she served as an Associate Justice of the Appellate Division Third Department.  Judge Stein received her J.D. from Albany Law School. 

Judge Eugene Fahey was appointed by Gov. Cuomo and was confirmed on the same day as Judge Stein.  Judge Fahey is set for retirement in 2021, as he reaches the mandatory retirement age on December 31, 2021.  Judge Fahey has also spent the last 20 years in the New York State judiciary.  Before serving on the Court of Appeals, Judge Fahey served as an Associate Justice of the Appellate Division Fourth Department.  Judge Fahey received his J.D. from the State University of New York at Buffalo.
