U.S. Supreme Court: Inter Partes Review Is Constitutional

This morning, the U.S. Supreme Court issued its decision in Oil States Energy Servs., LLC v. Greene’s Energy Grp., LLC, No. 16-712, __ U.S. __ (2018).  The Oil States decision confirmed the constitutionality of inter partes review. Slip op. at 17 (“Because inter partes review does not violate Article III or the Seventh Amendment, we affirm the judgment of the Court of Appeals.”).
