UPDATE: Fidelity National Financial Files SEC Notice Confirming November 2023 Data Breach

On January 9, 2024, Fidelity National Financial, Inc. (“FNF”) filed a notice of data breach with the Securities and Exchange Commission after discovering that an unauthorized party accessed its computer network through a cyberattack. In this notice, FNF explains that the incident resulted in an unauthorized party being able to access consumers’ sensitive information. Upon completing its investigation, FNF began sending out data breach notification letters to all individuals whose information was affected by the recent data security incident.

What Caused the Fidelity National Financial Data Breach?

The Fidelity National Financial data breach was only recently announced, and more information is expected soon. However, FNF’s filings with the Securities and Exchange Commission provide some important information on what led up to the breach. According to these filings, on November 19, 2023, Fidelity National Financial detected a cybersecurity incident that impacted some of its computer systems. In response, FNF secured its systems, notified law enforcement, and then launched an investigation to learn more about the nature and scope of the incident, as well as whether any consumer data was affected.

On December 13, 2023, Fidelity National Financial completed its initial investigation, which confirmed that an unauthorized third party accessed some FNF systems, deployed malware, and removed certain data. It was determined that the unauthorized access last occurred on November 20, 2023.

After learning that sensitive consumer data was accessible to an unauthorized party, Fidelity National Financial reviewed the compromised files to determine what information was leaked and which consumers were impacted.

On January 9, 2024, Fidelity National Financial filed its most recent notice with the SEC. In this notice, FNF indicated that it was in the process of sending out data breach letters to anyone who was affected by the recent data security incident. These letters should provide victims with a list of what information belonging to them was compromised.
