Wastewater Enforcement: Mississippi Commission on Environmental Quality and City of Maben, Mississippi Enter into Agreed Order

The Mississippi Commission on Environmental Quality (“MCEQ”) and the City of Maben, Mississippi (“City”) entered into a September 19th Agreed Order (“AO”) addressing alleged violations of a Clean Water Act National Pollution Discharge Elimination System (“NPDES”) permit. See Order No. 6793 17.

The City is stated to own and operate a wastewater treatment system (“System”) located in Webster County, Mississippi.

The system is operated pursuant to an NPDES permit. The AO provides that the City was notified through correspondence of the following violations:

  • Effluent total ammonia nitrogen limitation was exceeded and met the significant non-compliance criteria during 2015 and 2016
  • BOD No. 5-day effluent limitation was exceeded in 2015
  • BOD No. 5-day percent removal and total suspended solids percent removal limitations were exceeded in 2015 and 2016

The AO assesses a civil penalty of $1,000.
