Wastewater Enforcement: U.S. Environmental Protection Agency and Crawford, Mississippi, Public Owned Treatment Works Enter into Expedited Settlement Agreement

The United States Environmental Protection Agency (“EPA”) and Crawford Public Owned Treatment Works (“Crawford POTW”) entered into a July 27th Expedited Settlement Agreement (“ESA”). See Docket No. CWA-04-2021-0305(b).

The ESA provides that the Crawford POTW is in the town of Crawford, Mississippi.

The Crawford POTW is alleged to have failed to comply with a Clean Water Act National Pollution Discharge Elimination System (“NPDES”) permit.

The NPDES permit requires that the Crawford POTW:

. . . submit analytical results on an annual Discharge Monitoring Report (“DMR”) which are due each year by the 28th of January.

EPA is stated to have determined on November 5, 2020, through its Integrated Compliance Information System that Crawford POTW’s annual DRM analytical results had not been submitted for 2018 and 2019. Further, the ESA provides that through a review of additional information, EPA determined that the Crawford POTW violated Section 301 of the Clean Water Act.

A civil penalty of $810.00 is assessed.
