David Johnson will present on fiduciary cases from Texas courts from the summer of 2021 to the summer of 2022. This presentation will address the right to a jury trial for trust claims, the statute of limitations for claims against trustees, standing to file trust claims by a co-trustee, standing to file a trust claim by a contingent remainder beneficiary, the duties owed by a corporate director and whether any confidential relationship duties can arise, the construction of a trust document for income distributions, estate planning privity rule, aiding-and-abetting breach of fiduciary duty claims, whether a trust’s assets are separate of community property, a successor trustee’s right to manage assets, will execution, jurisdiction over trust disputes, and no-tort-liability findings in trust disputes.
