MSHA's new silica rule, finalized in 2024, represents a key legacy of the Biden Administration. Although compliance seemed distant when the rule was first issued, the deadlines for compliance are approaching: April 2025 for coal and April 2026 for metal/nonmetal operations. Anthony M. Casaletta is Senior Counsel with Conn Maciel Carey LLP, working in the Detroit area, where he provides the full range of workplace safety and health law services to employers in Michigan and around the country. Tony counsels and defends employers across a diverse range of industries in a wide variety of workplace health and safety matters involving Federal OSHA and State OSH Plans, particularly the Michigan Occupational Safety and Health Administration (“MIOSHA”). He supports clients in all aspects of enforcement actions involving OSHA agencies, from managing on-site inspections and investigations, to litigating contested OSHA citations, and counseling on compliance with OSHA enforcement rules and standards. Prior to entering private practice, Tony spent 18 years with Michigan OSHA in various roles, working his way up to Health Supervisor for the MIOSHA Construction Safety and Health Division.

Hema Steele is a Senior Counsel in Conn Maciel Carey LLP’s Columbus, OH office supporting the OSHA, MSHA, and Labor and Employment practice groups. Before joining CMC, Hema spent more than 11 years as a Solicitor with the United States Department of Labor, Office of the Solicitor (DOL) first as a Trial Attorney, then as a Senior Trial Attorney. Hema focuses on defending employers against OSHA and MSHA citations and working with them to ensure their safety programs and policies not only meet – but exceed – OSHA and MSHA requirements. She also represents and advises employers in all aspects of the employer-employee relationship including wage and hour claims, with a special focus on independent contractors and gig economy issues.
