A new world has just taken hold in Washington, DC, and with it, we expect OSHA to be much more open to employers’ views how regulatory programs should apply in their workplaces. This opens the door to regulatory strategies designed to obtain favorable OSHA interpretations of existing regulations, or perhaps even the availability of the historically rare regulatory variance. The OSH Act authorizes OSHA to grant temporary and permanent variances that allow an employer to deviate from the strict requirements of a regulation if the employer implements alternative protections to assure the workplace is “as safe as” it would otherwise be by complying with the regulatory requirement.
This webinar will review regulatory strategies that had been effectively foreclosed during the Obama Administration, but which may now be available to employers to craft practical solutions to unnecessary regulatory burdens while continuing to keep workers safe.

Kate M. McMahon
Kathryn M. McMahon is a partner in the national OSHA • Workplace Safety Practice Group of
Conn Maciel Carey LLP. She focuses her practice in the areas of occupational safety and health (OSHA) law and environmental law. Ms. McMahon helps clients manage incident and fatality inspections, and litigation related to alleged violations by federal OSHA and state OSHA programs. She also represents industry stakeholders in all aspects of OSHA rulemaking, including proposed rules regarding silica, injury and illness recordkeeping, hexavalent chromium, and beryllium, among others.
Micah Smith
Micah Smith is Of Counsel with the national OSHA • Workplace Safety Practice Group of
Conn Maciel Carey LLP. He focuses his practice in the areas of occupational safety and health (OSHA) law. Mr. Smith represents clients in the full range of OSHA-related matters across a wide range of industries, and works with his clients to identify safety and health strategies that both increase employee safety and improve business performance.
Andrew J. Sommer
Andrew J. Sommer is the Head of the San Francisco Office of Conn Maciel Carey.
Mr. Sommer advises employers on a wide range of employment-related issues, including Cal/OSHA regulatory matters. He defends employers against claims for wrongful termination, whistleblowing, discrimination, harassment, and wage and hour violations. He also counsels employers on employment-related issues.
