According to Isaac Boltansky of Compass Point, “the rubber will hit the road” tomorrow morning on whether Senator Harry Reid will “go nuclear” and seek to change Senate filibuster rules to only require 51 rather than 60 votes for Richard Cordray’s nomination as CFPB Director to proceed to a full Senate vote. This is because Senator Reid has scheduled votes for tomorrow morning  on whether to end debate on Mr. Cordray’s nomination and six other nominations made by President Obama. 

While he’s “inclined to believe” that Senate leaders will ultimately reach a deal that avoids the “nuclear option,” Mr. Boltansky nevertheless puts at “even money” the likelihood of a rule change for non-judicial nominees. If a rule change were to occur, Mr. Cordray would be expected to receive the 51 votes needed for confirmation.
